Creator Terms

1. Agreement and incorporated policies

These Creator Terms are between you and the ComePlay.GG early-access project; no company or LLC is represented as formed. They supplement the Member Terms, Refund and Cancellation Policy, Safety and Prohibited Services Policy, Privacy Notice, and Identity and Age Verification Notice. Where a creator-specific rule is stricter than a general Member rule, the creator-specific rule controls for creator activity.

ComePlay currently runs Stripe test mode. Test bookings create no creator earnings and no payout. Commercial provisions take effect only when ComePlay enables live payments and your dashboard confirms that your listing and Stripe Connect account are eligible.

2. Creator eligibility

During the initial commercial launch, you must be an adult located in Virginia, United States, personally control the linked Discord account, complete the configured government-ID, liveness, face-match, and age workflow, accept current policies, and maintain an eligible Stripe Connect account. You may not publish or deliver while a required gate is expired, incomplete, restricted, or under review.

Verification is not a background check, endorsement, or approval of your content. Do not send identity documents through Discord or ordinary support.

3. Independent business relationship

You are an independent service provider, not a ComePlay employee, worker, partner, franchisee, joint venturer, or general agent. You decide whether to list, what permitted service to offer, your availability, your listed price, and how to perform the service within the booking and safety rules. You have no authority to bind ComePlay or make promises on its behalf.

You supply your own computer, internet, games, accounts, equipment, workspace, skills, insurance, licenses, and expenses. You receive no wages, benefits, minimum hours, or guaranteed bookings. Nothing here overrides a worker-classification rule that applicable law makes nonwaivable.

4. Listings and creator content

• List only a permitted service you can personally deliver at the stated time, mode, duration, and price.
• Keep your identity, country, timezone, availability, experience, qualifications, game rank, and expected outcome accurate.
• Do not promise wins, rankings, earnings, health outcomes, relationships, exclusivity, or results outside your control.
• Do not use another person's image, name, music, game asset, trademark, or other content without the required rights.

You retain ownership of your creator content. You grant ComePlay a worldwide, nonexclusive, royalty-free, transferable and sublicensable license to host, copy, resize, format, display, distribute, and use your handle, name, image, likeness, bio, service details, and lawful excerpts of promotional content to operate, market, and improve ComePlay. The license ends when the content is no longer reasonably needed, except for lawful archival, evidence, transaction, and campaign copies. You represent that you hold the rights needed to grant this license.

ComePlay may provide limited brand assets or approved language for truthful promotion of your active listing. That permission is revocable and does not permit a confusing domain or handle, false endorsement, false employment or agency claim, altered mark, or sexual, illegal, or prohibited association with ComePlay. You must stop using the assets when the permission or your creator relationship ends.

5. Service delivery standards

Be ready at the scheduled time, use the restricted ComePlay session space, deliver the booked service for its stated duration, and report a material problem promptly. A restricted session space is access-controlled, not absolutely confidential; ComePlay operators, authorized administrators, Discord, and providers may retain technical access.

Respect boundaries and withdrawal of consent. Do not pressure a customer to provide private contact information, join a personal server, pay elsewhere, purchase another product, or continue after the scheduled end. You must protect customer information, use it only to deliver and support the booking, and not retain, sell, publish, profile, or contact the customer outside ComePlay without separate lawful consent.

Neither participant may record, screenshot, capture, rebroadcast, stream, publish, sell, or distribute any restricted session content. There is no informal-consent exception: permission in voice, chat, a direct message, or another service does not override this rule, because ComePlay does not provide an auditable recording-permission control. If you discover unauthorized capture or publication, preserve the URL and other lawful evidence without reposting the material, leave or end the session if needed, and use ComePlay's private reporting path. ComePlay cannot technically prevent every device-level capture or guarantee removal from another service.

6. Listed price and platform fee

You set the customer-facing session price. ComePlay's standard platform fee is 20% of the gross listed session price, excluding separately collected taxes. Your standard creator allocation is 80%. For example, a $100 session snapshots a $20 platform fee and an $80 creator allocation before a refund, reversal, chargeback, or other expressly authorized booking adjustment.

Unless the booking-level disclosure says otherwise, ComePlay bears ordinary Stripe processing fees out of its platform share rather than deducting them from your 80% allocation. ComePlay may offer a different fee only through a written campaign or account-specific term you accept before the affected booking.

7. Completion, review window, reserve, and payout

When live payments are enabled, a creator allocation remains pending until the scheduled session ends, operational completion checks pass, and the 72-hour Member issue window closes. The standard booking reserve continues for seven calendar days after the session. ComePlay then initiates the eligible transfer through Stripe Connect. Stripe's processing and bank schedules determine when the funds arrive.

A check-in, room-presence signal, or completion click alone cannot release money. ComePlay may hold the affected booking amount longer for an open refund, chargeback, safety case, fraud signal, legal process, Stripe restriction, negative balance, or reconciliation error. Where practical, ComePlay limits a hold to the amount and period reasonably related to the risk. Creator funds are not deposits, stored value, or an interest-bearing account.

8. Cancellations, refunds, and chargebacks

The platform Refund and Cancellation Policy controls. You may not replace it with a personal "no refunds" policy. If you cancel, do not attend after the grace period, or materially fail to deliver, your allocation may be reduced to zero and any transferred amount may be recovered. For an eligible Member late cancellation, the creator allocation is 80% of the amount retained under the Refund Policy.

ComePlay may reserve or offset only a documented refund, chargeback, transfer reversal, agreed fee, tax correction, or amount paid in error tied to your Creator transactions. It may use the related pending allocation or future payouts, and Stripe may apply its connected-account balance rules. ComePlay will provide written notice of the amount, affected transaction, reason category, and available appeal unless law or an active fraud investigation temporarily prohibits it. ComePlay will not use a Creator reserve to control how you perform lawful services or withhold unrelated qualified allocations indefinitely.

You must provide truthful, booking-relevant information and may not contact or pressure a customer to withdraw a report or card dispute. ComePlay will not charge you for a platform-controlled failure that you did not cause except where a card-network or legal rule requires a different allocation.

9. Taxes, records, permits, and insurance

You are responsible for your income taxes, business registrations, permits, game or software licenses, insurance, and records. You must give Stripe and ComePlay accurate legal, payout, and tax information. ComePlay or Stripe may report payments and issue an applicable Form 1099 when required. Receiving or not receiving a form does not change your obligation to report taxable income.

ComePlay will collect customer transaction taxes only where its configured payment model and law require. You must not represent that ComePlay has given you legal, tax, insurance, or accounting advice.

10. Anti-circumvention and platform integrity

Do not use a ComePlay lead, booking, restricted session space, or customer information to evade fees or move the booked service, renewal, or substantially similar paid service off-platform. Do not request payment by cash, gift card, crypto, bank transfer, PayPal, Venmo, or another external method. This restriction does not prevent lawful relationships you can document existed independently before the ComePlay introduction.

Do not scrape customer data, manipulate availability, create sham bookings, self-refer, collude on chargebacks, buy reviews, automate accounts, interfere with another listing, or use a personal audience to harass a customer or reporter.

11. Safety, reports, and cooperation

Services must remain nonsexual and nonromantic. Report suspected underage participation, credible threats, stalking, coercion, harassment, fraud, or serious policy evasion through the approved channel. Leave immediate danger and contact emergency services where appropriate. Do not investigate, confront, entrap, or publicly accuse a customer.

You must preserve relevant lawful records, cooperate reasonably with a booking or safety review, and keep case information confidential. Good-faith reports are protected. Retaliation, intimidation, altered evidence, coordinated reporting, and attempts to identify a reporter are prohibited.

At your request, ComePlay may help document or report an unauthorized recording or publication when a platform rule or legal right plausibly applies. Any authority to act for you must be separate, specific, truthful, and revocable; it does not transfer ownership of your content or authorize ComePlay to settle a claim, begin litigation, or make a copyright assertion you could not make yourself. A third-party platform makes its own removal decision.

12. Promotion and referrals

Promotions must be accurate, adults-only, nonsexual, nonromantic, non-spammy, and comply with platform and advertising rules. Clearly disclose paid, gifted, or affiliate relationships. A referral code creates no commission unless you separately enroll in and comply with the current Affiliate Program Terms.

13. Suspension and termination

ComePlay may restrict publication, new bookings, a session, transfer, or payout for verification expiry, inaccurate information, provider restrictions, safety, fraud, reconciliation, legal compliance, chargeback risk, or a suspected policy violation. Emergency action may occur before notice. Where practical, ComePlay will identify a reason category and review path.

You may unpublish or end your creator relationship after satisfying confirmed bookings and outstanding obligations. Termination does not eliminate refunds, chargebacks, taxes, confidentiality, evidence preservation, IP licenses for retained records, indemnity, dispute, or repayment obligations that arose earlier.

14. Creator promises

You represent that you are eligible, your information and content are accurate, you have the rights and qualifications you claim, your services comply with law and third-party rules, and you will not infringe, defraud, harm, discriminate against, or mislead a customer. You are responsible for your service and conduct.

15. Indemnity and liability

The disclaimers and liability limits in the Member Terms apply. To the extent permitted by law, you will defend, indemnify, and hold harmless ComePlay and its owners, officers, employees, contractors, and affiliates from third-party claims, losses, taxes, liabilities, refunds, penalties, and reasonable legal costs arising from your service, content, worker or tax status, violation of law or these terms, or infringement of another person's rights. This does not require you to indemnify ComePlay for ComePlay's own unlawful conduct.

16. Disputes and changes

The Member Terms' 60-day informal notice, 30-day arbitration opt-out, governing-law, venue, individual-proceeding, and jury-waiver provisions apply. An individual Creator dispute principally concerning compensation, worker status, classification, or the Creator work relationship will instead be administered by the American Arbitration Association under its then-current Employment/Workplace Arbitration Rules, subject to nonwaivable law. Eligible small-claims matters, requests for public injunctive relief, intellectual-property or unauthorized-access injunctions, and claims that cannot lawfully be arbitrated remain outside arbitration. The AAA Mass Arbitration Supplemental Rules apply when their published criteria are met; these Terms do not invent private batching.

Material changes receive a new version and require renewed acceptance before publication or another live commercial booking. Changes do not retroactively reduce an earned, reconciled creator allocation except as required for a refund, chargeback, correction, law, or an earlier accepted term.

Start at the ComePlay Help page. The current Discord session button creates a private owner-attention flag; it is not an emergency line or a complete legal, privacy, copyright, or payment claim by itself. Never put identity documents, card details, intimate media, or illegal content in Discord.
