Member Terms

1. Agreement and scope

These Member Terms are a binding agreement between you and the ComePlay.GG early-access project; no company or LLC is represented as formed("ComePlay," "we," "us," or "our"). They apply to the ComePlay website, Discord app and server workflows, bookings, restricted session spaces, and related support services.

By creating an account, accepting these Terms, booking, or joining a session, you agree to these Terms and the linked Privacy Notice, Refund and Cancellation Policy, Safety and Prohibited Services Policy, and Identity Verification Notice. If you do not agree, do not use a gated ComePlay feature.

The current product is a US early-access release running Stripe test mode. Test bookings are simulations: they create no charge, earnings, refund, payout, or cash value. Sections describing live payments take effect only after ComePlay expressly enables a paid US pilot.

2. Adults only and US-only launch

You must be at least 18 years old, located in the United States, able to enter a contract, and use a Discord account you control. You may not use ComePlay if you are suspended, prohibited by law, or acting for an undisclosed third party.

Booking and session access require the current age-assurance gate. Creator publication also requires identity verification. Verification is an eligibility control, not a criminal background check, endorsement, safety guarantee, or confirmation that a person's statements are true. 3. Marketplace role and contracting parties

ComePlay operates the marketplace, scheduling system, payment collection flow, Discord delivery tools, and support controls. Creators are independent service providers who describe and deliver their own permitted sessions. ComePlay is not the creator, employer, agent, dating service, escort service, medical provider, counselor, fiduciary, or guarantor of a session or participant.

For the planned platform-charge model, ComePlay will be the customer-facing merchant for payment collection and the receipt, while the selected Creator remains the provider of the booked session. A listing is an invitation to book. A booking becomes confirmed only when ComePlay receives authoritative payment confirmation from Stripe and records the booking as confirmed. Browser redirects, screenshots, check-in clicks, and Discord messages do not independently create or prove a paid booking.

4. Accounts and security

• Use one accurate account for yourself and keep it secure.
• Do not sell, lend, transfer, share, or automate your account or impersonate another person.
• Keep your Discord identity, verification state, and booking information current.
• Do not bypass or test access, age, payment, availability, rate limit, safety, or anti-fraud controls without written permission.
• Report suspected unauthorized access through the Help page immediately.

You are responsible for activity through your account to the extent permitted by law. ComePlay may require reauthentication or renewed verification after expiry, a material account change, or a reasonable fraud or safety signal.

5. Listings, bookings, and restricted session spaces

A booking covers the selected Creator, service, delivery mode, duration, scheduled time, and price shown in the final order review. Review the local date, time, timezone, cancellation terms, and total before confirming. Availability is not guaranteed until the booking is confirmed. ComePlay does not currently offer an in-place reschedule control. If plans change, use the supported cancellation control and create a new booking; the refund schedule in the Refund and Cancellation Policy applies to the original booking.

Sessions are delivered in a restricted ComePlay Discord session space and any game or screen-sharing tool identified in the listing. "Restricted" means access is limited by server permissions; it does not mean absolute confidentiality. ComePlay operators, authorized server administrators, Discord, and infrastructure providers may retain access as needed to operate, secure, or investigate the service.

Automated reminders, room presence, scheduled times, check-ins, and completion buttons are operational evidence, not conclusive proof of attendance, service quality, fault, a refund, or creator payout.

6. Prices, payment, and taxes

When live payments are enabled, the final checkout shows the session price and any separately required taxes. ComePlay's platform fee is deducted from the Creator's listed price and is not added as a separate customer fee unless checkout clearly says otherwise. ComePlay does not add a separate nonrefundable processing surcharge. Stripe hosts card entry; ComePlay does not store full card numbers or card security codes.

You authorize ComePlay and Stripe to charge the payment method you select for the confirmed booking and any amount you separately approve. You must use a payment method you are authorized to use. Currency conversion, bank, network, or card-issuer fees are governed by the institution charging them. ComePlay collects required sales or similar taxes where configured and shows them at checkout.

7. Conduct, consent, and prohibited services

ComePlay permits accurately described gaming, gameplay coaching or review, creator education, and ordinary nonsexual social conversation. It does not permit sexual services, adult content, dating, paid flirting, romantic simulation, escorting, in-person meetings, or coded attempts to sell those activities.

Consent is specific to the booked activity and may be withdrawn. Stop a topic, camera, screen share, game, or contact when asked. You must follow the Safety and Prohibited Services Policy, Discord's rules, applicable game rules, and applicable law.

A restricted session is a private, access-controlled service. You may not record audio or video, take screenshots, capture a screen share, rebroadcast, stream, publish, sell, or otherwise distribute any part of it. There is no consent exception: ComePlay does not provide an auditable recording-permission control, and off-platform permission does not override this rule. ComePlay cannot technically prevent every device-level capture.

8. Your content and ComePlay property

You retain ownership of content you submit. You grant ComePlay a worldwide, nonexclusive, royalty-free, sublicensable license to host, copy, format, display, and transmit that content only as reasonably needed to provide, secure, administer, and enforce ComePlay, process the transaction or case for which it was submitted, and comply with law. A license to market or promote ComePlay applies only to profile, listing, or other content you deliberately make public. It does not apply to content submitted through support, safety, verification, report, dispute, payment-review, or evidence channels. Those restricted materials may be used only to handle the applicable request or incident, secure and enforce the service, preserve required records, and comply with law. You represent that you have the rights needed to grant these licenses and that your content does not violate law or another person's rights. You may remove public content; ComePlay may retain legal, safety, financial, and audit copies as described in the Privacy Notice.

ComePlay's software, branding, design, documentation, and platform content are owned by ComePlay or its licensors. We grant you a limited, revocable, nontransferable right to use them for their intended purpose. You may not scrape, reverse engineer, copy, resell, interfere with, or create confusingly similar branding, except where law prohibits that restriction.

Nothing in these Terms prevents an honest review or requires you to transfer ownership of review content. That protection does not authorize disclosure of private or confidential session material, session recordings or captures, doxxing, impersonation, harassment, obscenity, sexualized use of another person's image or voice, infringement, or a clearly false or misleading statement. ComePlay may preserve evidence, restrict accounts, and submit a truthful privacy, safety, impersonation, trademark, or copyright report when ComePlay or an affected Creator has a valid basis. ComePlay will not knowingly make a false copyright claim merely to suppress criticism.

9. Cancellations, service issues, and reports

The Refund and Cancellation Policy is part of these Terms. A safety report, service complaint, refund request, and card dispute are separate processes and may have different outcomes. Your nonwaivable rights under applicable law remain available.

Good-faith reporting is protected. Fabricated reports, altered evidence, retaliation, intimidation, threats, doxxing, or coordinated misuse of a report or chargeback process may result in restrictions. An adverse decision alone does not prove report abuse.

10. Third-party services

ComePlay depends on Discord, Stripe, Supabase, Vercel, Didit when configured, games, and other third-party services. Their terms and privacy practices apply to their services. ComePlay does not control their availability, moderation, security, account decisions, or technical changes and is not responsible for third-party conduct beyond obligations that law cannot exclude.

11. Suspension and termination

ComePlay may restrict a feature, booking, session, listing, account, or related money movement when reasonably necessary for safety, fraud prevention, verification, payment reconciliation, provider requirements, suspected violations, legal compliance, or service security. Emergency or risk-based action may occur before notice. Where practical, ComePlay will provide a reason category and review path.

You may stop using ComePlay at any time. Ending access does not erase confirmed bookings, payment obligations, preservation duties, or provisions that by their nature survive, including ownership, payment, disclaimers, liability limits, indemnity, disputes, and record retention.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMEPLAY AND ITS SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." COMEPLAY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT A SESSION, CREATOR, RESULT, GAME, CONNECTION, OR THIRD-PARTY SERVICE WILL BE SAFE, AVAILABLE, ERROR-FREE, OR MEET YOUR EXPECTATIONS.

You assume the ordinary risks of communicating and playing games with other adults online. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMEPLAY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM COMEPLAY, A CREATOR, ANOTHER MEMBER, OR A THIRD-PARTY SERVICE.

COMEPLAY'S TOTAL LIABILITY ARISING FROM ALL CLAIMS WILL NOT EXCEED THE GREATER OF US$100 OR THE PLATFORM FEES COMEPLAY ACTUALLY RETAINED FROM YOUR BOOKINGS DURING THE 12 MONTHS BEFORE THE EVENT. These limits do not apply where prohibited, or to liability that cannot be limited, including liability for fraud or willful misconduct where applicable law so requires.

14. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless ComePlay and its owners, officers, employees, contractors, and affiliates from third-party claims, losses, liabilities, and reasonable legal costs arising from your content, your service or conduct, your violation of these Terms or law, or your infringement of another person's rights. ComePlay may control the defense of a covered claim, and you may not settle it in a way that admits fault or imposes obligations on ComePlay without written consent. This provision does not require a consumer to indemnify ComePlay for ComePlay's own unlawful conduct.

15. US dispute resolution

Before filing a formal claim, you and ComePlay will each send a written notice describing the claim and the relief requested, then allow 60 days for informal resolution. No public formal-notice channel is designated yet during early access. Live payments are not yet enabled; before they are, ComePlay will publish that channel and require acceptance of the then-current terms version. This step does not prevent either party from seeking urgent injunctive relief. Any applicable limitation period is tolled during this 60-day informal-resolution period.

Except for eligible small-claims matters, requests for public injunctive relief, intellectual-property or unauthorized-access claims seeking injunctive relief, and claims that cannot lawfully be arbitrated, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this clause. Proceedings will be virtual by default. If an in-person hearing is required, it will occur at a reasonably convenient location under the AAA rules, subject to nonwaivable law. A consumer's initial AAA filing fee will not exceed US$225, or a lower amount required by the AAA rules or law; ComePlay pays the remaining forum and arbitrator fees unless the arbitrator reallocates them as law permits. Arbitration must be individual: neither party may pursue a class, collective, consolidated, or representative merits proceeding. Each party waives a jury trial to the extent permitted by law.

If 25 or more substantially similar arbitration demands are filed against the same party and the AAA determines that its published mass-arbitration criteria are met, the AAA Mass Arbitration Supplemental Rules apply to administration of those individual cases. This sentence does not create private batching, bellwether, or global-settlement procedures beyond the AAA rules.

The commercial arbitration opt-out address, governing law, and court venue are not yet designated. The arbitration and venue terms in this section are proposed launch terms only while test mode has no cash value. ComePlay must publish the complete dispute terms and require acceptance of the applicable version before public enrollment or live payments.

16. General terms and changes

These Terms and incorporated policies are the entire agreement about ComePlay's Member service. If a specific checkout disclosure conflicts with a general policy, the specific disclosure controls for that booking. Failure to enforce a provision is not a waiver. Invalid provisions will be narrowed or severed, and the rest remain effective. You may not assign these Terms without written consent; ComePlay may assign them with its business or assets.

ComePlay is not liable for delay caused by events reasonably outside its control. Material changes receive a new version and, where required, renewed acceptance before another gated transaction. Changes do not retroactively alter a completed booking unless law requires it or both parties agree.

Questions, reports, or requests

Start at the ComePlay Help page. The current Discord session button creates a private owner-attention flag; it is not an emergency line or a complete legal, privacy, copyright, or payment claim by itself. Never put identity documents, card details, intimate media, or illegal content in Discord.
